1. Agreement to Terms

By accessing or using Sunset Predictor, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. User Accounts

When you create an account with us through Google sign-in or email/password registration, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from your profile settings.

3. Acceptable Use

You agree not to use Sunset Predictor:

  • In any way that violates any applicable national or international law or regulation
  • To transmit any unsolicited or unauthorized advertising or promotional material
  • To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service

4. User-Generated Content

By uploading photos or other content to Sunset Predictor (including the Community Gallery), you agree to the following:

  • You retain ownership of your content, but grant Sunset Predictor a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the Service
  • You represent that you own the content or have the right to share it, and that it does not violate any third-party rights
  • Uploaded content is subject to review and approval before being published. We reserve the right to reject or remove content at our sole discretion
  • We may send you email notifications regarding the status of your uploaded content (e.g., approval or rejection)
  • You may delete your uploaded content at any time from your profile. Deleted content will be removed from the Service

5. Use License

The free plan grants permission to access and use the Service for personal, non-commercial purposes only. Commercial use — including embedding widgets on a business website or app, or using the API inside a product you sell — requires a paid plan (Pro or Business) as described on our Pricing page. This license does not include:

  • The right to modify or copy the materials beyond what the Service itself provides
  • The right to resell, sublicense, or redistribute the Service itself
  • The right to remove any copyright or proprietary notations from the materials
  • The right to "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions.

6. Paid Plans, Billing & Refunds

Paid plans (Pro and Business) are billed in advance through our payment processor, Stripe, on a monthly or annual cycle as selected at checkout:

  • Prices are shown in EUR. We do not currently add VAT at checkout; depending on your location, you may be responsible for any applicable taxes.
  • Your subscription renews automatically at the end of each billing period until you cancel.
  • You may cancel at any time from the billing page via the Stripe customer portal. Your paid plan remains active until the end of the period you have already paid for, after which your account reverts to the free plan.
  • Payments are non-refundable and we do not provide prorated refunds for partial periods, except where required by applicable law.
  • We may change plan prices or features with at least 30 days' notice; changes take effect on your next billing period.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Sunset Predictor and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Weather data is provided by OpenWeather and is subject to their terms of use. Sunset predictions and quality scores are calculated using proprietary algorithms developed by Sunset Predictor.

8. Service Availability and Accuracy

We strive to provide reliable service, but we do not guarantee:

  • That the Service will be available at all times without interruption
  • That the Service will be free from errors, bugs, or security vulnerabilities
  • The accuracy, reliability, or completeness of sunset predictions
  • That weather data from third-party providers will always be accurate or up-to-date

The Service depends on third-party APIs (OpenWeather) and may be affected by their availability, accuracy, or changes to their services. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

9. Disclaimer

The Service is provided on an "as is" and "as available" basis. Sunset Predictor makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Sunset predictions are estimates based on weather data and atmospheric conditions. Actual sunset quality may vary. We do not warrant or make any representations concerning the accuracy, likely results, or reliability of sunset predictions. Use of the Service and reliance on predictions is at your own risk.

10. Limitations of Liability

In no event shall Sunset Predictor, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Reliance on sunset predictions or weather data provided through the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by deleting your account from your profile settings.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sunset Predictor and its licensors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Service operates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Dispute Resolution

If you have any dispute with us, you agree to first contact us at contact@sunset-predictor.com and attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal dispute resolution.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
